Terms of Service

1. Acceptance of Terms

By downloading, installing, or using PetSage AI ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

PetSage AI is operated by Michael Wilson, an independent developer based in Melbourne, Australia ("Developer", "we", "us").

2. Description of Service

PetSage AI is an iOS application that provides AI-powered pet health diary and tracking features, including diary logging, health monitoring, medication tracking, AI chat assistance, and document scanning. The App is powered in part by third-party AI services including the Anthropic Claude API.

3. Medical Disclaimer — Important

PetSage AI is not a substitute for professional veterinary care. The information and AI responses provided by the App are for informational and organisational purposes only and do not constitute veterinary advice, diagnosis, or treatment recommendations.

Always consult a qualified, licensed veterinarian for any health concerns about your pet. Never delay seeking veterinary advice because of something you read or were told by the App. In an emergency, contact your nearest emergency veterinary clinic immediately.

AI responses may occasionally be inaccurate, incomplete, or outdated. The Developer is not responsible for any harm to your pet that results from reliance on AI-generated content.

4. User Accounts & Eligibility

You must be at least 13 years of age to use PetSage AI. If you are under 18, you must have parental or guardian permission. By using the App, you represent that you meet these eligibility requirements.

The App does not currently require account creation. Your pet data is stored locally on your device.

5. Subscriptions & Payments

PetSage AI offers a free tier and a paid "Pro" subscription tier. Pro subscriptions are offered on a monthly ($3.99 AUD/month) or annual ($29.99 AUD/year) basis, with a 7-day free trial for new subscribers.

• Subscriptions are processed and managed by Apple's App Store.
• Payment is charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
• You can manage and cancel your subscription in your App Store account settings.
• No refunds are provided for partial subscription periods, except where required by applicable law.
• Prices may change at any time. We will provide reasonable notice of any price increases.

6. Acceptable Use

You agree not to use the App to:

• Violate any applicable law or regulation.
• Attempt to reverse engineer, decompile, or extract source code from the App.
• Use automated tools to scrape, extract, or abuse the AI features.
• Transmit any content that is illegal, harmful, or offensive.
• Attempt to circumvent subscription requirements or access Pro features without payment.

7. Intellectual Property

The App, including its design, code, branding, and content, is owned by the Developer and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the App on your personal devices for personal, non-commercial purposes.

Content you create within the App (diary entries, pet profiles, etc.) remains yours. You grant us no rights to your content beyond what is necessary to provide the service.

8. Third-Party Services

The App integrates with third-party services including Anthropic's Claude API. Use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the practices or content of third-party services.

9. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. We do not warrant the accuracy, completeness, or usefulness of any AI-generated content.

10. Limitation of Liability

To the maximum extent permitted by applicable law, the Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or damages resulting from reliance on AI-generated health information.

Where liability cannot be excluded by law (including under Australian Consumer Law), our liability is limited to the amount you paid for the App in the preceding 12 months, or the resupply of the service, whichever is lesser.

11. Australian Consumer Law

If you are an Australian consumer, you have rights under the Australian Consumer Law (ACL) that cannot be excluded. Nothing in these Terms is intended to exclude, restrict, or modify those rights.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via the App or by updating the date above. Continued use of the App after changes constitutes acceptance of the updated Terms.

13. Termination

We may suspend or terminate your access to the App at our discretion if you violate these Terms. You may stop using the App at any time by deleting it from your device.

14. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
